Terms of Service
SkateMaps is in active development. These terms govern current use and will be updated as new features (map, marketplace, DIY donations) ship. Registered users will be notified of material changes by email.
1. Agreement
By creating an account or otherwise using SkateMaps (the "Service"), you agree to these Terms of Service (the "Terms") and to our Privacy Policy.
If you do not agree, do not use the Service.
2. Who we are

3. What SkateMaps is
SkateMaps is a free, community-driven service that helps skaters discover skate spots, parks, and shops; share session footage; and connect with the broader skate community. We do not own or operate the physical locations shown on the map.
The Service is provided free of charge to skaters. Some optional features (marketplace fees, DIY donations to spot builders) may involve payments to third parties through third-party payment processors.
4. Eligibility
You must be at least 14 years old to use SkateMaps in Spain. In other countries, you must be at or above the local age of digital consent (typically 13 to 16). If you are under that age, you may use SkateMaps only with verifiable consent from a parent or legal guardian.
You must also be able to enter into a binding agreement under the laws of your country.
5. Your account
- Provide accurate information when you sign up and keep it up to date.
- Use a unique password and keep it confidential.
- You are responsible for activity that happens under your account. Notify us at [SUPPORT_CONTACT_EMAIL] if you suspect unauthorised use.
- One person, one account. Do not impersonate others.
- You may delete your account at any time from your settings. See the Privacy Policy for retention.
6. Your content
When you submit a spot, post a photo or video, write a comment, or otherwise contribute content to the Service ("User Content"), you keep ownership of it. You grant SkateMaps a worldwide, non-exclusive, royalty-free licence to host, store, display, adapt, and distribute that content for the purpose of operating, improving, and promoting the Service. The licence ends when you delete the content or your account, except where we are legally required to retain it.
By posting User Content, you confirm that:
- You have the right to share it and to grant the licence above.
- It does not infringe anyone's rights (copyright, privacy, publicity).
- It is accurate to the best of your knowledge.
- It complies with section 7 below.
7. Acceptable use
Do not use the Service to:
- Post illegal content, hate speech, harassment, threats, or sexual content.
- Reveal private information about other people without their consent.
- Post spam, scams, malware, or content designed to deceive other users (including fake spots).
- Impersonate any person or entity.
- Scrape, copy, or republish substantial portions of the Service without permission.
- Interfere with the Service's operation, security, or other users' access.
- Submit spots that endanger others or trespass on clearly posted private property without owner consent.
8. Spot accuracy and skating risk
Spots on SkateMaps are submitted and verified by the community. We do not guarantee that a spot is legal to skate, currently exists, is in the condition described, or is safe. Skate spots are dynamic — surfaces change, security tightens, spots get bulldozed.
Skating is inherently risky. You skate at your own risk. SkateMaps is not responsible for injuries, property damage, encounters with police, or legal consequences arising from your use of information found on the Service.
9. Moderation and termination
You can report content that violates these Terms from within the Service. We review reports and may, in our reasonable discretion, remove content, warn an account, restrict features, or terminate an account. Where the law allows, we will tell you why and how to appeal.
For serious or repeated violations, or for safety reasons, we may terminate immediately without prior notice.
10. Copyright
We respect copyright. If you believe content on SkateMaps infringes your work, send a notice with the information required by your local law (in the EU and US, this means a DMCA-style notice with your contact details, identification of the infringing material, and a sworn statement of good faith) to [COPYRIGHT_CONTACT_EMAIL]. Repeat infringers will have their accounts terminated.
11. Third-party services
The Service may link to or integrate with third-party services (for example, payment processors for the marketplace and donations, map providers, video hosts). Those services have their own terms and privacy policies, and we are not responsible for their conduct.
12. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so under Spanish or EU law (including liability for death or personal injury caused by our negligence, fraud, or gross negligence).
13. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amounts you paid us in the twelve months before the claim, or (b) one hundred euros (€100). We are not liable for indirect, incidental, special, consequential, or punitive damages. This limitation does not affect your mandatory consumer rights under Spanish and EU law.
14. Indemnity
You agree to defend and hold us harmless from claims arising out of (a) your User Content, (b) your breach of these Terms, or (c) your violation of any law or third-party right. This does not apply where our negligence or wilful misconduct caused the claim.
15. Your privacy rights
Depending on where you live, local law may give you rights over your personal data — for example, the right to access or delete it. You can download your data and delete your account at any time from your privacy settings ("Your Data").

16. Changes
We may update these Terms. For material changes, we will notify registered users by email at least 7 days before they take effect and update the "Last updated" date. Continued use of the Service after the effective date constitutes acceptance.
17. Governing law and disputes
These Terms are governed by Spanish law, without regard to its conflict of laws rules. If you are a consumer resident in the EU, you also benefit from mandatory protections of the law of your country of residence.
Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of [CITY_OF_JURISDICTION], Spain. Consumers may bring claims in the courts of their place of residence.
